Terms and Conditions

These Terms and Conditions will govern the product order placed by you with the The Aga Khan Museum, located at 77 Wynford Drive, Toronto, Ontario, M3C 1K1.

PAYMENT

You agree to pay the Aga Khan Museum the listed price for your order, including any taxes, duties, levies, and shipping and handling costs, if any, by providing your credit card information at the time of placing the order. All prices are in Canadian dollars. All prices are subject to change without notice.

SECURITY AND PERSONAL INFORMATION

The Aga Khan Museum uses security safeguards to protect your personal and credit card information while you are shopping. SSL (Secure Sockets Layer) technology protects the security and integrity of the personal information you provide while shopping online at the AKM. This security protocol encrypts data transmissions between a web browser and website, and helps ensure that this information will only be decrypted at its intended destination.

Your acceptance of these Terms and Conditions includes your consent to the collection, use, and disclosure of your personal information for the purposes of: providing you with the goods and services requested, communicating with you regarding service delivery, marketing and for other matters that are communicated to you, as well as for such other purposes that are described in our Privacy Statement available on our website.

The Aga Khan Museum takes the safety and wellbeing of our visitors, invitees and personnel very seriously. To help play our part in stopping the spread of COVID-19, the Aga Khan Museum will fully support the efforts and measures of Public Health authorities and other government bodies and agencies. From time to time, the Aga Khan Museum might be asked to share details about our visitors and invitees with such government authorities in order to support their emergency response efforts. In other instances, the AKM might become aware of a visitor, invitee, or personnel member who has a confirmed case of COVID-19 or who has come in close contact with a person who has a confirmed case of COVID-19. The AKM is committed to informing our visitors of any such confirmed cases that pose a health and safety risk. Such notification will be done in an anonymized and non-identifiable manner and in accordance with applicable privacy laws. In addition to the earlier consents provided by you on the collection, disclosure, use, and storage of your personal information, you understand and agree that the personal information you share with us may also be disclosed to, and used by, Public Health authorities where required or permitted by law. Subject any other permissions you have given us, the AKM will only retain such personal information for as long as is reasonably necessary for the purposes set out in these Terms and Conditions or for as long as required by law. Any questions regarding the collection, use, disclosure, and storage of your personal information may be directed to privacyofficer@agakhanmuseum.org.

CANCELLATION AND REFUND

Programs and prices are subject to change without notice. Tickets for performances, lectures, and special events are final sale and are non-transferrable and non-refundable.

The Aga Khan Museum reserves the right to cancel events or performances, for which a full refund will be forthcoming. You will automatically be notified if an event you have purchased admission for has been cancelled or rescheduled, as long as you have provided us with a valid e-mail address or phone number.

LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW. IN ANY EVENT, LIABILITY FOR ALL CLAIMS SHALL NOT EXCEED THE AMOUNT PAID FOR THE ITEM, SERVICE OR PROGRAM ORDERED. INDEMNITY

You agree to indemnify and hold the Aga Khan Museum, its affiliates and subsidiaries, and their respective officers, directors, members, employees, agents, third-party content providers, sponsors, licensors, or the like, harmless from any loss, expense, or damage, including reasonable legal fees or costs incurred (“Losses”), arising from any action, claim, suit, or demand (“Claims”) asserted by any person or entity against the AKM, its affiliates and/or subsidiaries, their respective officers, directors, members, employees, agents, third-party content providers, sponsors, licensors, or the like following a data breach and from any Losses arising from any Claims related to, based on or arising from your breach or non-performance of these Terms and Conditions, including any claim for infringement of a third party’s intellectual property, property, personality, privacy rights, or moral rights. This section shall survive the termination of these Terms and Conditions.

GENERAL

These Terms and Conditions shall be governed by the laws of the Province of Ontario and the federal laws of Canada, and you consent to the exclusive jurisdiction of the courts of Ontario in all disputes arising out of or relating to these Terms and Conditions without regard to the conflict of laws. The parties hereby expressly exclude the application of the United Nations Convention on Contracts for the International Sale of Goods (Ontario) as amended, replaced, or re-enacted from time to time. These Terms and Conditions constitute the entire agreement between you and the Aga Khan Museum with respect to products or services provided by the Aga Khan Museum and it supersedes all prior agreements between you and the AKM in this respect. These Terms and Conditions are periodically reviewed and may be modified when necessary or appropriate.A printed or electronic version of these Terms and Conditions shall be admissible in judicial or administrative proceedings based upon or relating to these Terms and Conditions to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.
